04.01.01 – TERMS AND CONDITIONS

Your cake order is extremely important, therefore please take the time to read our Terms and Conditions below. All cakes ordered from Cakery Corner are subject to the following Terms and Conditions. By confirming your order by making a deposit, or full payment, you are confirming that you have a read, understood and agree to the these Terms and Conditions.

QUOTATION DETAILS
Cake details, price, information and collection/ delivery details will placed on a Cakery Corner Quotation/ Order Form, which contains a unique quotation number. Should any changes be made to the quote a new quotation number will be issued. Please check the information thoroughly to ensure all details are correct as this will form the basis of your Order Confirmation. Cakery Corner can accept no responsibility of incorrect information being placed on the cake (names, ages etc) of which it uses the Quotation/ Order form as reference for spellings etc.

Cakery Corner will hold your event date for 3 days from the date the quotation was sent in order for a deposit or full payment to be made. If no payment has been received then Cakery Corner reserve the right to offer the date to another customer. If you want to place an order after these 3 days, you must contact Cakery Corner to ensure the date is still available.

ORDER, DEPOSIT & PAYMENT
In order to secure your event date/ order a deposit is required. All deposits are non refundable and non transferable.

FOR ORDERS UNDER £100.00
A deposit of £20 is required in order to secure your event date and production time.
Full payment needs to be made at least 2 weeks before collection/ delivery date.

FOR ORDERS OVER £100
A deposit is 50% of the total order value in order to secure your event date and production time.
Full payment needs to be made at least 2 weeks before collection/ delivery date.

FOR ORDERS OVER £200
A deposit is 50% of the total order value in order to secure your event date and production time.
Full payment needs to be made at least 2 months before collection/ delivery date.

By confirming your order by making a deposit, or full payment, you are confirming that you have a read, understood and agree to the these Terms and Conditions.

Of course, you may wish to make the full payment, rather than a deposit and further payment, of which Cakery Corner accepts.
On receipt of the cleared deposit or full payment, Cakery Corner will provide the customer with an Order Confirmation. At this point the customer needs to check the order fully in order to make sure all details are correct. Should any details be incorrect, the customer needs to contact Cakery Corner immediately.
If no Order Confirmation is received within 3 days of payment being made, the customer needs to contact Cakery Corner in order to check that payment has been received.
If a deposit has been made, then payment of the remaining order value needs to be made in full and cleared as per the conditions above, dependant on order value. In the event of non-payment of the balance, Cakery Corner reserves the right to consider the order contract void, the order will be cancelled and the deposit forfeited.

Please note that any cake ordered of which a picture or photo of a cake provided, it can only be reproduced by Cakery Corner as our interpretation of that cake and will not be an exact reproduction of the cake in the picture or photo.

CHANGES
Every effort will be made to accommodate changes made to orders, however please note that any changes cannot always be guaranteed and may be subject to additional charges. Any change must be submitted in writing and it is the responsibility of the customer to ensure receipt.

COLLECTION
All customers are welcome to collect their cake from our business premises. Times and dates are subject to availability. On collection, the customer, or their representative is required to sign a form to confirm receipt and good condition of the cake.

Once the cake has been collected and signed for by the customer or their representative, they  assume all liability and responsibility for the cake as soon as it leaves Cakery Corners possession. Cakery Corner is unable to accept liability for any interference with or damage to the cake thereafter.

Please note that once collection time is agreed it must be adhered to. A small margin either side of the collection time can be accommodated but Cakery Corner cannot be held responsible if the customer turns up either earlier or later than the agreed time and collection is not possible.

DELIVERY
Cakes can be delivered and are subject to availability, prior agreement and at cost to the customer. Current pricing for delivery is 60p per mile for the total journey – with a minimum charge of £10 and rounded up to the next pound. This is based on mileage from our postcode to delivery postcode using Google Maps – for example if the delivery postcode is 15 miles from Cakery Corner, price would be 60p multiplied by 30 (miles there and back) giving a delivery price of £18. Please remember that it is not just fuel that needs to be covered, but time, insurance etc.

It is the customer’s responsibility to ensure they have given Cakery Corner the correct delivery information, and that someone is available to receive the cake. Cakery Corner requires a signature on delivery by the recipient to say that the cake has arrived good condition – photographs will be taken as proof. We operate “No signature – No Cake!”.  If delivery is attempted and we are unable to leave the cake (for example because nobody is available to take receipt) then Cakery Corner will return to our premises with the cake. It is the responsibility of the customer to arrange redelivery, at cost to the customer.

Damages after point of delivery are not the responsibility of Cakery Corner.

Delivery service is subject to reasonable access conditions. If in the unlikely event we are unable to deliver your cake due to adverse weather conditions such as snow or floods, these conditions may make your venue inaccessible and delivery will not be possible and cannot accept liability if delivery is not possible.

Cakery Corner will do everything possible to ensure your cake arrives on time, but cannot accept liability for late deliveries. Arrangements for delivery may be subject to change, however prior notice will be given where possible.

SETTING UP
If you have opted for setting up this will be shown on your order form and charged accordingly. Setup fee is charged separately from delivery charge at a standard rate of £20 which allows up to 2 hours for getting the cake into the venue, stacking, applying pieces and photographing/ gaining receipt from recipient the cake.

The customer needs to arrange a time with the venue that will be suitable to delivery and setup of the cake. If Cakery Corner are not able to set up within the 2 hours due to the venue not being ready, it will become the responsibility of the venue to set up the cake and Cakery Corner accepts no responsibility for damage done to the cake from handover.

Cakery Corner will deliver and set up the cake as agreed and will ensure it is displayed at its best. It is the customers responsibility to ensure that the correct set-up details and arrangements are made with the venue and are given to Cakery Corner for the location and display of the cake. The customer needs to discuss and agree on a suitable location for the cake with the venue. We advise that when displaying the cake to avoid direct sunlight, spotlights or candles which could cause damage to the cake and decorations. Hand-painted cakes are especially vulnerable to heat and light damage. All of our cakes are designed to withstand normal and reasonable display conditions. Cakery Corner accepts no liability for cakes that are damaged during display at your event and cannot take any responsibility if damage is done to the cake due to an unstable table or a table placed on an unstable surface. Photograph of the cake will be taken and a signature take prior to departure to verify that the cake has been set up and left in good condition.

Once the cake has been delivered, set up and signed for, Cakery Corner is unable to accept liability for any interference with or damage to the cake thereafter.

CUTTING
Cakery Corner does not provide cutting knives or a cutting service. Please ask your venue.

CAKE STANDS
Should a cake be placed on a cake stand provided by the venue or the customer, it is the customers responsibility to ensure that the stand is suitable and stable enough to hold the cake being placed on it. Details of the cake stand will also need to be sent to Cakery Corner to ensure that the cake requested will be able to fit on the stand being provided.

If cake stand(s) have been hired from Cakery Corner, price of the cake will include a refundable deposit. The stand(s) must be returned to Cakery Corner premises within 3 days of the event date in an undamaged condition. Once Cakery Corner is in possession of the stands and can confirm there is no damage will the refund be issued. Cakery Corner will inspect the stand(s) within 48 hours of being returned – therefore it is not possible to issue an on the spot returnable deposit. Returnable deposits are made by bank transfer. Please ensure details are with Cakery Corner in order for us to process a timely refund.

COLOUR MATCHES
Cakery Corner will make every effort to colour match material, photos or other items you provide as closely as possible. However, please note that some colours cannot be recreated in sugarpaste, buttercream etc and therefore may not be a perfect match.

DESIGN MATCHES
Cakery Corner will make every effort to replicate designs of cakes sent to us. However, please note that with sugar being the working medium, it will not be an exact copy.

FRESH FLOWERS/ PLANTS
Cakery Corner is unable to source fresh flowers/ plants for the cake – this needs to be arranged by the customer. Please note some flowers/ plants are toxic. It is the customer’s responsibility to ensure that any fresh flowers/ plants displayed on or next to the cake do not contain pesticides and are food-safe. Cakery Corner can take no responsibility for fresh flowers/ plants being used.

Should a request for fresh flowers/ plants on a cake be made, it is the customer’s responsibility to liaise with their florist to determine the type to be used. It would be helpful to communicate this decision with Cakery Corner.

Once Cakery Corner has set up the cake at the venue and the cake has been signed for, Cakery Corner do not take any responsibility for any damage to the cake from the fresh flowers/ plants, or the placement on the cake of the fresh flowers/ plants.

CANCELLATION
In the event of Customer Cancellation; If for any reason you should need to cancel your order, as previously stated deposit is non refundable and non transferable. All cancellations must be submitted in writing and it is the responsibility of the customer to ensure receipt of the cancellation.  On receipt of the cancellation you will be sent a cancellation confirmation. Any charges incurred and materials already purchased for your order are non-refundable and time spent on any decorative pieces for your order will be charged accordingly.

In the event of Cakery Corner Cancellation; If for any reason beyond control e.g. Illness, injury or unforeseen circumstances and your order is not able to be completed, Cakery Corner is only limited to refunding any monies paid by the customer, be it deposit or full payment.

COMPLAINTS
Complaints are taken extremely seriously and need to be given to Cakery Corner in writing no later than 24 hours after collection/ delivery. Should the need arise, Cakery Corner can request that cakes be returned by the customer and this is required within 24 hours of complaint in order for us to investigate fully.

Any refund given for disputes regarding a cake design or production of a design are completely at the discretion of Cakery Corner and are not automatic.  Refunds will never be given for any cake which has been partly or fully consumed regardless of dispute, as consumption of the cake is viewed as your acceptance that the cake is adequate for the purpose for which it has been supplied. Under no circumstances will the full amount be refunded.

IMAGES
Cakery Corner reserve the right to use images of any cake made for, but not limited to, promotional purposes, social media, websites, displays etc after the event without compensation to the customer. If you wish for us to delay putting a picture up publicly, for example if the cake is as a gift and there is a risk of the recipient seeing before being given the cake) then please let Cakery Corner know and we will do our best to accommodate this.

ALLERGENS
It is the customers duty to inform Cakery Corner of any dietary requirements. Cakes made by Cakery Corner contain butter, gluten (wheat) and eggs and are made in an environment that handles milk, wheat, nuts, soy and other allergens. The customer agrees to inform guests of this risk and does not hold Cakery Corner responsible for any allergic reactions that may occur from consuming our cakes.
